PitlaneOne - Terms of Use

Introduction

The following Terms of Use apply to the mobile app PitlaneOne and all related web services (collectively "the Application") published by DevAttendant (collectively "the Author"). By accessing or using the Application You agree to have read and understood the following Terms of Use as well as the Privacy Policy and You agree to use the Application only with complete observance of the Terms.

The Author may change the Terms of Use as well as the Privacy Policy without prior notice. Whenever any changes happen, all users are notified through any part of the Application about the changes. Continued use of the Application after any notification includes the acceptance of the changed terms. If You do not agree to the changed terms, You should immediately stop using the Application and submit a request to receive a refund of Your subscription for the remaining period.

License

The Author grants You a limited, non-transferrable, non-exclusive and revocable license to use the Application for your personal and non-commercial purposes. The Author may terminate this license at any time for any reason.

You are not entitled to use the Application if you are at the age of 14 or under. If You are under 18 years of age, You may only use the Application if You possess legal parental or guardian consent and if You are able to understand and enter the Terms of Use.

Proprietary Rights

The Application and its components including, but not limited to software, graphics, images, audio, documentation, logos, text and other intellectual property rights related to the Application are owned by the Author. Such rights are protected by international copyright laws and treaty provisions. You agree not to sell, license, distribute, modify, reproduce or publicly perform any elements belonging to the Application and its components. You further agree not to decompile, reverse engineer, disassemble or to derive the source code of the Application.

You may choose to or the Author may invite You to submit any feedback, comments and ideas (collectively "Idea") to improve or modify the Application. By submitting an Idea You agree that Your disclosure is gratuitous, unsolicited and without restriction and will not place the author under any fiduciary or other obligation. You agree that the Author is free to disclose the Idea on a non-confidential basis to anyone or otherwise use the idea without any additional compensation. You further acknowledge that, by acceptance of Your submission, the Author does not waive any rights to use similar or related ideas previously known to the Author, or obtained from other sources.

Disclaimer of Warranties

The Author has made reasonable tests and checks to confirm that the Application will perform in normal use on compatible equipment as described in the current specifications for the Application. Due to the complex nature of software and hardware combinations the Author cannot warrant that the Application is free of erros, will operate without any interruptions or is compatible with any available hardware, operating system and software configuration.

Therefore the Application is licensed "AS IS" and the use of the Application is at own risk. It is provided without warranties of any kind, whether express or implied including, but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement of third-party rights. Without limiting the foregoing, the Author, its subsidiaries, and its licensors do not warrant that the content is accurate, reliable or correct; that the Application meets Your expectations or requirements; that the Application is continuously available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the Application is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Application is downloaded at Your own risk and You are solely responsible for any damage to Your computer system or mobile device or loss of data that results from such download.

The Author cannot be made responsible for any issues related to poor, limited or restricted internet access. It is possible that the Application does not work correctly or at all in certain regions in the world, either due to lack of internet access or due to restricted internet access. You agree that in this circumstances the Author is not liable and You cannot request any refund of any subscription.

Limitation of Liability

In no circumstance will the Author be liable for any direct, indirect, incidental or consequential damages arising out of the use of the Application. Further the Author will not be held liable for intentional or incidental ignorance of rules and laws published by the government of the country You live in. You take full responsibility and guard the Author against any claims from any third-party.

Indemnity

You agree to defend, indemnify and hold harmless the Author and its subsidiaries, agents, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from Your use of and access to the Application, including any data or work transmitted or received by You; violation of any term of this License Agreement, including without limitation, breach of any of the representations and warranties above; violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; violation of any law, rule or regulation of any country; any claim or damages that arise as a result of any of Your posted content or any that are submitted via Your account; or any other party’s access and use of the Application with Your unique username, password or other appropriate security code.

Termination of Use

The Author may temporarily or permanently suspend or terminate access to the Application without prior notice and liability, if You are considered to be violating any of the Terms of Use, in the author's sole determination. This also applys to prohibited actions including, but not limited to compromising system integrity or security of any servers the Application is based on, taking any action that may impose an unreasonably large load on the servers, uploading invalid data such as viruses or other harmful software or bypassing the measures the Author may take to prevent or restrict access to the Application.

Return Policy

The Application can be downloaded for free from certain app stores.

The Author can terminate the Application at any time without prior notice to the user.

Third-Party Terms of Use

Please note that Your access to and the ability to use the Application may be subject to third-party Terms of Use including, but not limited to the App Store, software platforms and payment providers. You recognize and agree that the Author is not liable for any such third-party Terms of Use.
